SwisscomPay Terms of Use

1. General Terms

For the use of the SwisscomPay service provided by Swisscom (Switzerland) Ltd (hereinafter “Swisscom”), the following terms of use and general terms and conditions of Swisscom apply for mobile network services. You can find the latter on the website at www.swisscom.ch or in any point of sale.

2. Swisscom services

2.1 General

Easypay is a simple and secure solution from Swisscom that allows Swisscom customers with a valid Swisscom contract to pay for content. Easypay allows the customer to pay for content from third parties (hereinafter “Provider”) without disclosing any of the customer's personal data (except MSISDN). No registration is required by the customer.

2.2 Procedure and charges:

Each purchase is shown to the customer on a dedicated “Checkout Easypay” page. By clicking on “Purchase”, the customer agrees to the content being charged directly to the Swisscom bill or being deducted from the prepaid balance. The customer can either purchase one-off content or content for use over a specific period of time (subscriptions and trial subscriptions). Subscriptions and trial subscriptions are renewed automatically if they are not terminated. Terminations are possible at any time by contacting the provider directly, or at the Swisscom customer centre for private customers. Purchase of a subscription is confirmed by text message. The customer also receives confirmation by text message a few days before a trial subscription is extended, and after terminating a subscription.
For data transmission, the normal costs apply in accordance with the price plan of the contract with Swisscom.

2.3 Restrictions:

Swisscom does not guarantee uninterrupted availability of the Easypay service. If the customer is using an external network at the time of intended use, the corresponding service only works if there is a valid roaming contract for this purpose. The way the content is transmitted is decided by the roaming partner. The use of streaming services through mobile networks abroad is not permitted by Swisscom. Swisscom may block customers and providers at any time if this is warranted by objective reasons relating to security, or if unauthorised or fraudulent use of Easypay is suspected. Furthermore, Swisscom may block customers at any time if certain spending limits have been reached, or the customers themselves have initiated a blockage. Swisscom reserves the right to exclude customers from content with adult entertainment, and can set appropriate age limits and change them at any time.

3. Customer obligations

3.1 Duty of care

The customer is obliged to take due care that unauthorised third parties do not carry out transactions at the expense of the customer in the name of the customer.

4. Special provisions

4.1 Mobile telephone numbers (MSISDN):

Swisscom can forward mobile telephone numbers to third parties as part of a specific service reference.

4.2 Guarantee/liability

Swisscom is not responsible for content from providers which is paid for via Easypay, nor if there is a link to the content is on websites (using a hyperlink). The use of the Internet (including news groups, etc.) is at the customer's own risk and is subject to the applicable national and international regulations. Swisscom excludes any guarantee for content paid for using Easypay. In the event of discrepancies, the customer must abide by the provider. Swisscom is only liable for damages incurred in relation to the use of the Easypay service in the event of wilful or gross negligence. Swisscom excludes any liability for damage caused by the content of the provider.

5. Changes and discontinuation of the service

Swisscom reserves the right to change the Easypay service and these Terms of Use at any time or to terminate or discontinue the service. The current version of the aforementioned document applies, and it is recommended that the customer consult it periodically. For further information, go to here.
